Argos Construction, appointed by a consortium, had to intervene once a construction project had already been launched. The situation was that a 12 months delay prevented to carry out works. Important financial loss was forecasted if the consortium wished to complete them in accordance with the planning. Argos established a clear view of the situation and prepared the claim statement. The claim was made to the Administration Court which entitled the consortium to additional payments. A proper contract management with efficient practices and tools such as regular written mails to evaluate the overall situation in relationship with the sequence of events would have avoided unpleasant surprises.

Assist the company and the legal admuinistrator in the analysis of the contractual situation and challenges of this transaction
Objectives

Analysis of the contractual documents and of the administrative and technical records

Implementation of and monitoring a database relating to contractual management

Review of the established calculation and assistance in the determination of the additional calculations.

Review and assistance in the drafting of the letters during the work and concernig the claim.

Preparation and drafting of the statement of claim (argument and written document)

Assistance in the defense of the statement of claim.
